Presently, the only legitimate way to grow hemp in New York is by participating in the New York Industrial Hemp Agricultural Research Pilot Program. Those interested must apply to the New York Department of Agriculture and Markets, which costs $500. Approved applicants receive a Research Partner Agreement.

The 2018 Farm Bill legislation does not mean that CBD derived from hemp is universally legal throughout the United States. According to the Farm Bill, the Food and Drug Administration (FDA) has the power to regulate CBD product labeling, including therapeutic claims and the use of CBD as a food additive. The FDA has already maintained that even hemp-derived CBD may not legally be added to food and beverages, or marketed as a dietary supplement. Although the organization has begun to re-evaluate some of these stances on legal CBD products, the FDA has not revised its regulations. The agency also has been strict in its position against any labeling that could be perceived as a medical claim about CBD.

CBD balms, salves, lotions, and tinctures can be purchased from small pharmacists, specialty stores, CBD storefronts, and vape stores. Food and beverage retailers may offer CBD products, but they are not legal.

Reviewers especially highlight the customer service and product selection.

Hemp-derived CBD has been legal for medical and recreational use in New York since the initial Farm Bill, the Agricultural Act of 2014. Of course, this only continued to expand in 2018. Now, there are plenty of shops all throughout the Big Apple that carry CBD. As of 2019, the only hemp-derived CBD products that are still in limbo are consumables. Food and drinks containing CBD are legal to possess and to use in New York State, but restaurants and retailers may face significant fines for selling them. The only thing we suggest is ordering your edible CBD products online, other than that CBD is completely free game in New York.

Is CBD Legal in New York?

Currently, lawmakers in the state of New York–particularly those that represent the districts of New York City and the surrounding areas–are working towards legalizing recreational marijuana use in the state. Back in 2014, the Compassionate Care Act was signed into law. This established legal protections for the use of medical cannabis but progress has essentially been stalled since 2015 when critically ill patients gained access to the drug. As of 2019, recreational marijuana use lacks the legislative support to, but in its wake, the medical program could finally see important progress. Without meeting medical requirements, you can’t use marijuana-derived CBD in New York.
